Warrants

Certain offenses can result in a warrant being issued for one’s arrest. Warrants can be issued at various times and are generally not served right away for one reason or another. If you have an outstanding warrant it is best to take steps to clear the warrant to prevent greater consequences from happening in the future. Types of Warrants:

 In Texas, there are various types of arrest warrants. Each type serves a specific  function within the legal system.

 

  1. Arrest Warrant: issued when probable cause has been believed to be determined someone has committed a crime. It authorizes law enforcement to take the person into custody. Texas tends to treat a “capias” and a “warrant” interchangeably. 
  2. Bench Warrant: generally issued by a judge when a person fails to appear in court or comply with a court order
  3. Search Warrant: permits law enforcement to search a specific location for evidence that could potentially lead to a person’s arrest 
  4. Summons: requires a person to appear before the court without being taken into custody. Failure to comply with a summons can result in the issuance of a warrant. 
  5. Fugitive Warrant: issued for a person who has fled to avoid prosecution of an alleged crime or incarceration. 
  6. Governor’s Warrant: issued for the extradition of a wanted person in another state. 
  7. Order of Commitment: authorizes the detention of a person to serve a sentence or to fulfill a court order. 
  8. Surety to Surrender: allows a bail bondsman to request the return of a defendant to custody, generally when they have violated bond conditions.
